Evaluating insurance coverage on a construction claim can be a complicated proposition when dealing with just one insured and one insurance policy. When you add multiple lines of coverage and policies, multiple insureds, and non-insureds as well as competing interests, the complexity increases exponentially. This session addresses the interplay created when addressing a claim involving multiple policies, coverages, contracts, and parties – and a finite amount of money. A case study will be used.

Learning Objectives:
  • Obtain various perspectives gleaned from experience when identifying and coordinating multiple policies, coverages, and competing interests.
  • Demonstrate through a case study some of the policies that may be impacted by potential alleged defects and damages.
  • Recognize which coverages apply to what parts of the claim, including the identification of potential policies and coverages by tendering entity, and more.
  • Understand the consequences associated with coordinating the defense of multiple coverages, multiple insureds, and multiple carriers.
